[1] The present petition has been filed by the petitioner for quashing and setting the impugned interim order dated 25.01.2012 passed by the learned Central Government Industrial Tribunal - Cum - Labour Court, Ahmedabad in CGITA No.1428 of 2004. The learned Tribunal has held that the first party was given opportunity to justify its action so taken against the delinquent workman in dismissing the workmen from the service by adducing evidence and fresh material before the Tribunal.
[2] It is clarified that while considering the record, it will be open for the petitioner to adduce evidence and fresh material before the Tribunal and the Tribunal will consider the same independently and will try to dispose of as expeditiously as possible. Petition stands disposed of. It is clarified that the Court has not entered into the merits of the case.
