Heard learned counsel for the applicant and learned Standing Counsel.
The applicant is before this Court against the wilful defiance of the status quo order dated 16.2.2000 passed in Writ Petition No.7815 of 2000 (Rajesh v. DDC, Ballia & Ors.).
Learned counsel for the applicant in support of his submissions has filed various documents including the photographs on the basis of which he has tried to contend that the the order in question has been flouted.
The Court has proceeded to examine the record in question and find that highly disputed facts have been urged before this Court. Admittedly the writ petition in question is pending consideration, wherein status quo order has been passed. From the material produced before this Court, the Court is not inclined to proceed in matter under the Contempt of Courts Act. However, this order would not preclude the applicant to agitate his rights in the pending writ petition in question.
The contempt application stands disposed of accordingly. Notices, if any, stand discharged.
