Heard learned counsel for the applicant and the learned A.G.A.
This is a bail application on behalf of the applicant Ajit in connection with Case Crime No.46 of 2020, under Sections 302, 504 and 506 I.P.C., P.S. Sahatawar, District Ballia.
F.I.R. of the incident was lodged by the complainant about the death of her father committed by the present applicant and his wife. The present applicant is said to have assaulted the deceased with knife. The deceased was taken to the hospital where he died.
Learned counsel for the applicant submitted that the applicant is quite innocent and has been falsely implicated in the present case. Alleged incident occurred in the house and no one has tried to save the deceased. There was no blood mark on the deceased. He further submitted that present applicant has been nominated in this matter only to grab the property of the present applicant.
Learned counsel for the complainant and learned A.G.A. vehemently opposed the prayer for bail of the applicant.
Learned counsel for the complainant submitted that present applicant was assigned the specific role of assaulting the deceased with knife and as many as seven knife injuries were received on the person of the deceased. He further submitted that there is no question of implicating the present applicant falsely as he is close relative (real uncle) of the complainant.
Considering the overall facts and circumstances, the nature of allegations, the gravity of offence, the severity of punishment, the evidence appearing in the case, particularly that the accused has been assigned the role of causing injuries to the deceased, without expressing any opinion on merits, this Court does not find it to be a fit case for bail at this stage.
Accordingly, the bail application stands rejected.
