Heard learned counsel for the applicants, learned AGA and perused the record.
Supplementary affidavit filed taken on record. Counsel for the applicants submitted that the applicants were falsely implicated who has already been released on bail in Case Crime No. 372 of 2009, under Sections 325, 323, 504, 427 I.P.C., Police Station Sadat, District Ghaziabad. However, subsequently section 308 I.P.C. was added. The prayer is to issue direction to the Trial Court to release fresh bail bond. Learned AGA has opposed the aforesaid prayer on the ground that since the grievous of the offence has been added hence not entitled to be released on same bail order.
In view of the fact if the applicants appear and move bail application within three weeks' under newly added section 308 I.P.C., the same shall be considered as expeditiously as possible preferably on the same day. Accordingly, the application is finally disposed off. Order Date :- 25.1.2010 Manoj
