1. The petitioner who was working with Standard Chartered Bank on the post of Cashier was dismissed vide impugned order dated 14.12.2018 passed by the Bank.
2. Standard Chartered Bank is not a State within the meaning of Article 12 of the Constitution of India. Merely on the ground that since the banks are functioning under the RBI/Banking Regulations it does not mean that the RBI or the Central Government has pervasive control over the functioning of the Bank. Neither RBI nor the Government controls day to day functioning of the Bank. Standard Chartered Bank is a Multi National Company. The Bank is not a State within the meaning of Article 12 of the Constitution of India, therefore, the writ petition is not maintainable and as such the same is dismissed. However, the petitioner would be at liberty to approach any other forum/Court of competent jurisdiction for redressal of his grievance, if so advised.
