JUDGMENT / ORDER

Heard, learned advocate for the petitioner.
Petitioner, by way of this petition approaches this Court with grievance qua the criterion adopted by the respondent Corporation for awarding promotion to the officers of ONGC from E-5 level to E-6 level. Learned advocate for the petitioner contended that 20 marks for the determination of various criteria is unfortunate and arbitrary, unfair, discriminatory, unconstitutional, irrational, illogical and it is required to be set aside. The petitioner is at Sr. No. 1093 in the seniority list whereas juniors have been given promotion and petitioner has apprehension that promotion orders will be issued today and therefore he has to work under the junior persons.
The Court is not inclined to pass any mandatory orders as criterion, which is sought to be challenged and are have been made basis for making promotion are on the book since 2002 as can be seen from Annexure E at page 237 of the petition, meaning thereby, petitioner is aware of this criterion as the criterion is available since 2002 and relying upon this criteria there is no mandatory relief at this stage.
Hence, let there be a Notice returnable on 22.01.2013.
It goes without saying that promotion orders issued or effected would be resulted by the final outcome of this petition.
In addition to regular mode of service, Notice may be sent by way of Speed Post at petitioner s cost, which can be deposited by learned advocate for the petitioner.
