JUDGMENT / ORDER

It is submitted by Mr.Kanojiya, learned advocate for the petitioners that under the Banking Act, relevant documents like statement of accounts are destroyed after period of seven years and so for the production of documents i.e. statement of accounts, present petitioners have preferred application. It is further submitted that copies of said documents are placed on record before the Trial Court by the petitioners and application Exh.208 is not filed for avoiding hearing of application Exh.5.
In view of above, Notice returnable on 18.01.2013. It is clarified that there is no stay over the proceedings of the Trial Court and the Trial Court is at liberty to proceed with the matter.
