Heard learned counsel for petitioner and learned A.G.A. as well as perused records.
After arguing at some length, learned counsel for petitioner submits that he shall file an application for discharge which may be considered by the Court below.
In view of aforesaid, learned counsel for petitioner is permitted to move a discharge application on behalf of the petitioner through counsel. In case such a discharge application is moved within two weeks from today, the same shall be considered and decided by by the court concerned by an speaking and reasoned order within a period of three weeks from the date of its filing in accordance with law.
For a period of five weeks no coercive action shall be taken against the petitioner in case S.T. No. 236 of 2016 ( State Versus Rajesh) arising out of Case Crime No. 663 of 2015 under section 307 I.P.C. P.S. Zarif Nagar district Budaun pending in the court of 6th Additional District and Sessions Judge, Budaun.
With the aforesaid, the petition is disposed of.
