Court No. - 21
Case :- WRIT - C No. - 10893 of 2018 Petitioner :- Rajesh Pandey Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Dinesh Kumar Singh Counsel for Respondent :- C.S.C.
Hon'ble Krishna Murari,J. Hon'ble Ajay Bhanot,J.
Grievance of the petitioner is that on account of undefined boundaries, respondent nos. 4 to 6 are encroaching upon bhoomidhari land of the petitioner and no action has been taken on the application moved by the petitioner before respondent no. 3 for demarcation.
From a perusal of the application, we find that it has been moved on Tehsil Diwas, whereas a proper application is to be moved in the court of Sub Divisional Officer under Section 24 of the U.P. Revenue Code, which prescribes detailed procedure to settle the dispute regarding boundaries.
In such circumstances, we dismiss the writ petition with liberty to the petitioner to make an application before the relevant authority under the provisions of U.P. Revenue Code, 2006 for redressal of his grievances.
