Heard learned counsel for the petitioner.
The petitioner has preferred the present petition inter-alia with the prayer to set aside the order dated 7.9.2020 passed by Additional District Judge, Court No.4, Hathras.
It is argued by counsel for the petitioner that wholly illegally and without assigning any valid reasons the application filed by the petitioner dated 11.11.2019 which was filed in Original Suit No.258 of 2004 was rejected.
The matter requires consideration.
Issue notice to respondents returnable at an early date. Steps be taken within ten days.
Counter affidavit be filed by all the respondents within four weeks. Rejoinder affidavit may be filed within two weeks' thereafter.
List immediately after service of notice.
Civil Misc. Stay Application No.1 of 2020 No case is made out for grant of interim protection. The application for stay is rejected.
