Heard learned counsel for the applicant and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to quash the criminal proceeding of Case no.1246 of 2018 arising out of Case Crime No.111/2018, State of U.P. Vs. Ashish Tiwari and others, under Section 379, 411 I.P.C., PS Jigna, District Mirzapur.
Learned counsel for the applicant submits that he has been falsely implicated by the police under the alleged sections.
In that view of the matter, he is permitted to move discharge application through counsel before the trial Court within a period of three weeks and the trial court shall decide the same within a period of one month from the date of production of a certified copy of this order along with application.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid directions, application stands disposed of.
