The matter is taken up through Video Conferencing.
The petitioners by way of present petition seek following directions:-
"i. Issue a writ or direction or pass an appropriate order in the nature of Mandamus commanding, Bank of India, Etawah (respondent no.2), to decide petitioner's representation dated 27.12.2020 (Annexure no.8), and to release petitioners share in the balance amount remaining i.e. Rs. 1,53,80,557, as per Section 45 of the Transfer of Property Act, alongwith interest at 12% per annum from the date the amount obtained after e-auction was deposited with the bank till the date of its actual payment, as expeditiously as possible and within such shortest possible time frame which the Hon'ble Court may deem fit and proper in the facts and circumstances of the case. "
After arguing for some time, learned counsel for the petitioners prays for withdrawal of petition with liberty to approach appropriate forum for redressal of grievance.
Prayer is allowed.
Petition is dismissed as withdrawn with the said liberty.
