Heard Shri Dilip Singh, learned counsel for the petitioner and the learned standing counsel for the respondents no. 1 and 2.
The petitioner is seeking a direction to the respondents to promote the petitioner on the post of Assistant Clerk under 50% promotional quota in terms of Section 2(2) of Chapter III of the U.P. Intermediate Education Act. In this context the petitioner is stated to have submitted his representation dated 22.1.2018, Annexure-2 to the writ petition, before the District Magistrate with the copy of the District Inspector of Schools, Bareilly under receiving dated 29.1.2018.
No useful purpose would be served in keeping this writ petition pending.
This is writ petition is therefore disposed of with a direction to the respondent no. 2-District Inspector of Schools, Bareilly to examine the matter and pass appropriate orders in accordance with law within a period of three months from the date of receipt of the certified copy of this order.
Alongwith certified copy of this order, the petitioner shall also provide a copy of his representation dated 22.1.2018 to the respondent no. 2.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
