The petitioner has prayed the following prayer:
"The Hon'ble Court may kindly be pleased to issue an ad-interim mandamus directing the respondents authorities the open meeting for selection of fair price shop dealer will be held at Gram Panchayat Simara, Taluka Ghunchiyai Tehsil Puranpur, District-Pilibhit according to report dated 11.5.2018 submitted by Nayab Tehsildar Tehsil Puranpur, District-Pilibhit otherwise the petitioner shall suffer irreparable loss and injury and/or pass such other and further order or direction which this Hon'ble Court may deem fit and proper under the circumstances of the case."
It is not for the petitioner to decide where an open meeting of the Gram Panchayat shall be held. The petitioner has no enforceable right, to insist on a particular place, where the Gram Panchayat shall hold an open meeting. A decision shall be taken by the competent authority considering the convenience of the villagers and all other relevant factors.
The writ petition is dismissed.
