Heard learned counsel for the petitioners, Shri Ramakant Dubey, learned Standing Counsel for the State respondents and Shri Manoj Kumar Yadav, learned counsel for third respondent.
Notice need not be issued to the private respondents, in view of the order proposed to be passed.
The petitioners are before this Court with request to issue direction to the Sub Divisional Magistrate, Machhalishahar, District Jaunpur to decide Revision no.T201814360305790 (Rajesh and others vs. Gram Sabha and others) in a proceeding under Section 24 of U.P. Revenue Code, 2006 Arazi no.25 area 0.259 hectare, Arazi no.26/1 area 0.36 hectare, Arazi no.77 area 0.065 hectare, Arazi no.78 area 0.194 hectare situated in Village Aashapur, Pargana Mugara, Tehsil Machhalishahar, District Jaunpur, expeditiously.
Learned Standing Counsel and Shri Manoj Kumar Yadav, Advocate very fairly state that in case the aforesaid case is still pending, the same shall be considered and decided by the Authority concerned expeditiously.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Sub Divisional Magistrate, Machhalishahar, District Jaunpur to expedite the hearing of the aforesaid case and conclude the same expeditiously, preferably within a period of four months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost but certainly after according opportunity of hearing to all the stake holders in the matter.
