|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 39882 of 2002 Petitioner :- Rajesh Kumar Respondent :- State Of U.P. And Others Counsel for Petitioner :- A.N. Bhargava,Jay Singh,Manoj Gosharami,Virendra Singh Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"(a) issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 24.08.2002 passed by respondent no. 2 as per amended petition by Hon'ble Court order dated 2.8.2006.
(b) issue a writ of certiorari to quash the impugned order dated 4.8.2003 passed by respondents after summon the records from the respondents pertaining to the petitioner service with direction for reinstate with salary.
(c) issue a writ of mandamus commanding the respondent to regularize the services of the petitioner in compliance of order passed by against the vacant post, which the petitioner held.
(d) issue a writ of mandamus commanding the respondent not to fill up one post of Theater Techincian for OBC as published in Newspaper Amar Ujala dated 20.09.2005 with order or direction to quash the said notification as published pertaining to the post of Theater Techincian."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
