Learned counsel for the applicant has prayed that he may be permitted to amend the prayer clause as he has omitted to mention offence under Section 308 and 325 IPC.
The prayer is allowed.
Let the necessary correction be made during the course of the day.
Heard Sri Amit Srivastava, learned counsel for the applicant and Sri G.P. Singh, learned A.G.A. for the State.
The present application has been filed with a prayer to direct the court below to hear and decide the S.T. No. 683 of 2016 in Crl. Case No. 3147 of 2016 arising out of case crime no. 53 of 2016, under Sections 324, 308, 325 and 452 IPC, P.S. Malpura, District Agra pending before the Additional District Judge, Agra expeditiously.
It has been argued by the learned counsel for the applicant that a direction may be issued to the court below to decide the aforesaid case as the case is pending since 2016. The applicant is complainant of this case.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of one year without permitting undue adjournments to either side, if there is no legal impediment.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court.
