Heard learned counsel for the petitioners and Shri Sanjay Kumar Singh, learned Standing Counsel.
In view of the order proposed to be passed, notices need not go to private respondent.
The petitioners are before this Court assailing the order dated 9.1.2018 passed by fourth respondent-Tehsildar, Tehsil Bhadohi, Distt. Bhadohi in Original Suit No.553 of 2002 (Dharmraj v. Ram Aasni) under Section 34 of LR Act and for a direction to fourth respondent to decide the aforesaid suit under Section 34 of LR Act within stipulated period.
The Court has proceeded to examine the record in question and does not find any infirmity or illegality in the order impugned. However, considering the facts and circumstances of the case without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the fourth respondent to consider and decide the aforesaid suit in accordance with law expeditiously and preferably within four months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting any unnecessary adjournment to either of the parties except upon payment of cost.
