Heard learned counsel for the petitioners/defendants.
In view of the order proposed to be passed, notices need not go to the private respondents.
The petitioners/defendants are before this Court for a direction to Civil Judge (J.D.), Sambhal to decide the application dated 19.11.2019 filed under Order 7 Rule 11 CPC in Original Suit No.1123 of 2018 (Sanjay Singh and another Vs. Fariyad Ali and others) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (J.D.), Sambhal to consider and decide the aforesaid case/suit in accordance with law expeditiously and preferably within a period of six months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
