Heard learned counsel for the parties.
The petitioner is before this Court with request to issue direction to the respondents not to interfere in his working as Class-IV employee in the institution in question and to pay his monthly salary regularly on the said post and arrears of salary from the date of his joining.
Learned counsel for the petitioner submits that the institution in question is an intermediate institution, duly recognized and in grant-in-aid of the State. Provisions of Intermediate Education Act, 1921 and U.P. High School and Intermediate College (Payment of Salaries of the Teachers and Other Employees) Act, 1971 are applicable on the institution. The petitioner claims to have been appointed as Class-IV employee against the vacancies having arisen in the institution. He has confined his prayer only to the relief that his last representation dated 04.02.2017 may be considered by the appropriate authority.
Learned Additional Chief Standing Counsel for the State respondents has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the District Inspector of Schools, Ballia to decide the petitioner's representation in accordance with law within a period of two months from the date of production of a certified copy of this order before him.
