Preliminary objection is raised by Sri R.P. Shukla, appearing for the respondents, on the ground that the order of dismissal was assailed in appeal, which has been dismissed on 7.12.2017. It is stated that the order passed in appeal has not been challenged.
Faced with the aforesaid objection, learned counsel for the petitioner comes up with the prayer to withdraw the writ petition with liberty to file afresh, challenging the appellate order also.
Prayer made is allowed.
Writ petition is, accordingly, dismissed as withdrawn with liberty, as prayed.
