In terms of order dated 29.8.2017, the Director of Higher Education was required to consider the case of the applicant for regularisation of his service as Lecturer in Degree College, within period of two months from the date of presentation of certified of the order.
Sri P.K. Giri, learned Additional Chief Standing Counsel, on instructions from opposite party, has placed on record an order dated 22.9.2018 passed by him in purported compliance of the directions issued by the writ Court. By the said order, the claim of the applicant for regularisation has been turned down. A copy of the said order has been made available to learned counsel for the applicant.
Counsel for the applicant tried to contend that the order passed by the opposite party is illegal and contrary to the directions issued by the writ Court.
Since a decision has already been taken in the matter, therefore, this Court is not inclined to examine its validity in the instant proceedings, but leaves it open to the applicant to challenge the same before appropriate forum.
The contempt application stands disposed of with the above observation.
