Heard Shri R.K. Shukla, learned counsel for the petitioner; Shri Deepak Kumar Singh, learned State Law Officer for the State respondents and Shri Manu Singh, learned counsel appearing for the Gaon Sabha.
By means of present writ petition, the petitioner is assailing the validity of the order impugned dated 17.9.2018 by which the fair price shop licence of the petitioner has been placed under suspension.
Learned counsel for the petitioner precisely submits that against the suspension order the petitioner has filed detailed objection on 4.10.2018 and the same is yet to be decided. Meanwhile, the respondents are proceeding for fresh allotment in favour of other incumbent and such situation has impelled the petitioner to approach this Court.
Learned State Law Officer fairly states that in case the matter is still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case and with the consent of parties, this writ petition is disposed of finally with a direction to the second respondent, Sub Divisional Officer, Aliganj, District Etah to take a final call in the matter, taking into account the objection of the petitioner within a period of three weeks from the date of production of a certified copy of this order before him. Meanwhile, if any fresh allotment of the fair price shop in question is made, the same shall be subject to the final decision in the matter.
