Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with following prayer:-
"(i) Issue an appropriate writ order or direction in the nature of mandamus commanding the respondent no. 2/ Licensing Authority Etawah to consider and register the Arms License (Rifle) No. 58/ 2020 of petitioner and renewed the same in accordance with law within stipulated period.
(ii) Issue suitable writ order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case in the interest of the case.
(iii) Award the cost of the writ petition in favor of the petitioner."
The petitioner herin is an ex- army man.
The case of the petitioner is that he had applied for registration of an arms licence on 17.06.2019 but no order has been passed and the said application is still pending with the District Magistrate/ Licensing Authority, Etawah.
Considering the facts and circumstances of this case, this writ petition is finally disposed of with the direction that the application of the petitioner dated 17.06.2019 shall be considered and decided by the respondent no. 2, Licensing Authority (Arms)/ District Magistrate, Etawah, in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of production of self- attested copy of this order, which may be verified from the official website of this Court.
While arguing the case, learned counsel for the petitioner has further submitted that fire arm, which is lying with the petitioner may be permitted to deposit till any decision is taken by the authority concerned for removal/ registration of the fire arms license. The authority concerned is competent to consider this prayer also of the petitioner and therefore, no additional direction are required.
With the aforesaid observation/ direction, present petition stands disposed of.
