Heard learned counsel for the petitioner and Sri Satish Kishore Kakkar, learned counsel for the respondents.
The petitioner was selected for appointment as an Officer in Junior Management Scale- I with the respondent Bank on 01.04.2015. During pre-joining formalities, it was revealed that a criminal case was pending against the petitioner and, therefore, he was requested to apprise the status of the said case and to submit the final decision thereof as a precondition for joining.
The petitioner could not get the aforesaid case decided and submitted the final decision thereof. Accordingly, vide order dated 30.11.2015 as the new recruitment process was going to be started, the respondents cancelled the selection of the petitioner.
The aforesaid order dated 30.11.2015 has been challenged by the petitioner by means of this writ petition and it is alleged that the petitioner has been acquitted from the criminal case vide judgement and order dated 6th December, 2017 and, therefore, he should be allowed to join his duties pursuant to his selection. The relief claimed by the petitioner is completely misconceived, as much before the acquittal of the petitioner in the criminal case, his selection stood cancelled on 30.11.2015. The challenge to the cancellation of the selection at such a distance of time, particularly when the post has been re- advertised cannot be permitted. The writ petition is accordingly dismissed.
