Heard learned counsel for the applicant and learned A.G.A. appearing for State and perused the record.
This application under Section 482 Cr.P.C. has been filed with the prayer to quash judgement and order dated 20.03.2021 passed by Additional District and Sessions Judge, Court No.12, Moradabad in Criminal Revision No.99 of 2020 (Anil Kumar Versus State of U.P. and another) arising out of Criminal Complaint Case No.1355 of 2019 (Rajesh Kumar Versus Anil Kumar and others) under Sections 420/120-B I.P.C., Police Station Civil Lines,District Moradabad.
I have heard learned counsel for the applican and learned AGA. and have gone through the materials available on record carefully and I do not find any substance in the arguments advanced by learned Counsel for the applicants.
Contention of the learned counsel for the applicant is based on two counts. Firstly, he has argued that no reason has been assigned in the impugned order passed by revisional court while remanding back the matter to the learned Magistrate and secondly, he has directed the Magistrate concerned to hear both the parties which is not necessary at the stage of summoning.
So for as first argument of learned counsel for the applicant is concerned, the revisional court has observed that civil litigation is pending between the parties before competent court and that the original will-deed has not been placed on record. However, the second argument of the applicant has force that at the stage of summoning hearing of accused is not required.
No interference is required by this Court invoking provisions of Section 482 Cr.P.C. However, the learned Magistrate is expected to decide aforesaid complaint in accordance with law as expeditiously as possible.
However, it is made clear that this Court has not expressed any opinion on the merits of the case and the competent Court below is to act, in accordance with law.
