Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that in fct the applicant is B.Tech. graduate from Dr.M.G.R. University, Chennai, Tamil Nadu. He was in search of the job. A letter was issued for a job from Gallery Hotel London and as per the demand Rs.29,000/- and Rs.43,700/- were deposited on two different dates by father of the applicant. However, the applicant could not get the aforesaid fact. The applicant was himself victim. It appears that co-accused Mustaque was involved in cheating the young boys and girls who were in search of job. The applicant was also implicated along with him though he himself was cheated by Mustaque. Co-accused Toki Rani has already been released on bail. In fact the money was deposited in the account of the applicant by his father and by the applicant which was earned from some petty job. However, the applicant is in jail since 14.5.09. There is no criminal history against the applicant.
In view of the above without observation on merit let the applicant Rajesh Kumar alias Bhawani Shanker be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No.227 of 2009 under Section 420, 467, 468/34 I.P.C. PS. Sector 49, Noida, District Gautam Budh Nagar.
