Learned counsel for the applicants alleges non-compliance of the order of writ Court dated 31.10.2013 passed in Writ Petition No. 6654 (S/S) of 2013 (Rajesh Kumar & 33 others Vs. State of U.P. and others), whereby writ Court directed the applicants to move fresh representation before the Secretary, Medical Education, U.P., Lucknow within two weeks from the date of order in respect of their grievance, which they have raised in the said writ petition, annexing all relevant documents and materials in support of the case and after receiving the same, Secretary, Medical Education, U.P., Lucknow was required to consider and dispose of the same by speaking and reasoned order in accordance with law within a further period of eight weeks thereafter.
Submission of learned counsel for the applicants is that copy of the order of writ Court along with representation was sent through registered post on 14.12.2013 followed by reminder on 05.03.2014, but till date in compliance of the order of writ Court no action has been taken by the opposite party. Therefore, the applicants are constrained to approach this Court by means of present Contempt Petition for initiating proceedings against the opposite party under the provisions of Contempt of Court Act for willful disobedience of order dated 31.10.2013 of the writ Court.
On due consideration, prima facie, a case of willful disobedience of the order of writ Court is made out.
Let notice be issued to opposite party to appear before this Court on 06.08.2014 to show cause as to why proceedings be not initiated against him under the provisions of Contempt of Court Act for willful disobedience of order of the writ Court dated 31.10.2013 passed in Writ Petition No. 6654 (S/S) of 2013 (Rajesh Kumar & 33 others Vs. State of U.P. and others).
It is provided that if order of the writ Court is complied with and compliance report is filed, the opposite party need not appear before this Court on the date fixed.
