JUDGMENT / ORDER

The petitioner herein is the accused in CC No.324/2009 on the file of Judicial First Class Magistrate Court, Changanacherry. He seeks a direction under Article 227 of the Constitution of India for the speedy disposal of the case. His grievance is that in spite of warrant issued from the Court, the Police could not procure the presence of the witnesses, and trial is thus being prolonged. Of course, a direction to dispose of the matter within a particular period cannot be granted in the particular facts and circumstances where the trial court will have its own reason for such delay. Any way there can be a direction to dispose of the matter as expeditiously as possible, and to take necessary coercive steps and action to procure the presence of the material witnesses. In the result this Crl.M.C. is closed with a direction to the court below to expedite trial in CC No.324/2009 as indicated above.
