Heard Shri Upendra Upadhyay for the petitioner and Shri Jai Prakash Tripathi, learned AGA for the State.
This writ petition has been filed by the petitioner seeking direction to the police authorities to conduct fair and proper investigation in respect of Crime No. 285 of 2018 for the offence under Sections 419, 420, 467, 468, 409 of IPC, P.S.-Chaubeypur, District Varanasi.
According to the petitioner, on 14.6.2018, he lodged an FIR against respondent No. 4 but till date the investigation has not been completed nor the report has been filed. Learned counsel submits that a direction may be issued to the police authorities to investigate the matter fairly and impartially.
State counsel submits that the police authorities are under the obligation to do the investigation fairly and expeditiously and the same would be done in accordance with law.
The present petition is disposed of directing the police authorities to conclude the investigation of the said case expeditiously in accordance with law, preferably within a period of three months from the date of production of a certified copy of this order.
It is made clear that this Court has not observed anything on the merits of the case and the investigation shall be carried out in accordance with law.
