Heard Sri Manu Saxena, learned counsel for the petitioner.
The present writ petition has been filed seeking following relief :
"issue a direction for early disposal of P.A. Case No. 6 of 2013 (Rajesh Arora vs. Sanjay Kesarwali), pending in the Court of Additional Chief Judicial Magistrate-3rd, Allahabad, within time specified by this Hon'ble Court."
On 16.8.2021, this Court passed the following order:
"The Court has perused the report of the Additional Civil Judge (Senior Division)/ACJM, Court No. 3, Allahabad acting as the Prescribed Authority under U.P. Act No. 13 of 1972 dated 11.08.2021. The explanation for the delay in disposal of proceedings under Section 21(1)(a) of the Act fails to impress this Court. According to the report, the next date fixed is 14.09.2021.
The Prescribed Authority shall proceed with the hearing of the application on 14.09.2021 and attempt to conclude the same on the said date or within a week thereafter, proceeding on a day to day basis. Learned counsel appearing for the parties in the matter shall be under a direction to appear and assist the Court on every date, irrespective of resolutions passed by their local Bar Association, if any. The learned District Judge, Allahabad shall ensure that learned counsel appearing in this case are not obstructed in the discharge of their functions on account of any Bar resolution.
Lay this matter as fresh again on 21.09.2021 when a fresh status report shall be submitted by the Prescribed Authority/Additional Civil Judge (Senior Division), Allahabad concerned.
Let this order be communicated to the Prescribed Authority/Additional Civil Judge (Senior Division), Allahabad through the learned District Judge, Allahabad and to the District Judge, Allahabad by the Registrar (Compliance) within 24 hours."
Pursuant to the order dated 16.8.2021 a report has been submitted by the court concerned that the aforesaid case has been finally decided on 18.9.2021, a copy of the report dated 20.9.2021 is available on record.
Since the proceeding of the aforesaid case stands concluded, no order needs to be passed.
The writ petition has been rendered infructuous. It is accordingly, dismissed.
