Heard learned counsel for the petitioner, Sri Manoj Kumar Yadav, learned counsel for the respondent No.5 and learned Standing Counsel for the respondents No.1 to 4.
Petitioner has approached this Court seeking following reliefs:
"(a) To issue a writ, order or direction in the nature of mandamus commanding/directing the respondents No.2 to 4 not to demarcate the land again being plot Nos. 321 and 508 situated in village Bagharwara, Pargana Anguli, Tehsil Shahganj, District-Jaunpur during the pendency of the proceeding before the authority concerned, disturbing the possession of the petitioner over his plot No.509;
(b) To issue a writ, order or direction in the nature of mandamus commanding/directing the respondents not to disturb in the peaceful possession and enjoyment of the petitioner over his plot No.509 situated in village Bagharwara, Pargana Anguli, Tehsil Shahganj, District-Jaunpur."
Learned counsel for the petitioner submitted that there was unauthorized possession over the chakroad. On complaint demarcation was made. Now, again the villagers including the respondents No.6 and 7 are trying to grab/encroach the said land, even earlier notice was given but no appropriate action was taken by the authority concerned including the Gaon Sabha to remove the unauthorized possession from the chakroad.
If complaint/any proceeding is pending in respect of the removal of the encroachment from the chakroad/the land of the Gaon Sabha, the respondents No.2 and 3 shall look into the matter and take appropriate action at earliest in accordance with law, preferably, within a period of three weeks from the date of production of a certified copy of this order.
With the aforesaid observation, the writ petition is disposed of.
