Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondent.
By means of this writ petition, the following relief has been sought -
"(i) Issue a writ, order or direction in the nature of mandamus commanding the respondent no.1 to decide the restoration application no.138 of 2019, Computer Case No.T- 201905440400138 (Rajbali Versus Salmati) under Section 35 of Uttar Pradesh Revenue Code, 2006 pending before the Court of Tehsildar , Tehsil Kasia District Kushinagar within a stipulated period."
It is stated that a restoration for recall of an exparte mutation order passed in favour of the contesting respondent filed on 22.06.2006 has not been disposed of till date.
Under the circumstances, this writ petition is disposed of directing the respondent no.1, Tehsildar, Tehsil Kasia District Kushinagar to endeavour to decide the application of the petitioner, expeditiously, preferably within a period of two months from the date a certified copy of this order before it.
