Heard learned counsel for the petitioner and Shri Diwakar Singh for the Gaon Sabha, respondent no.4.
By means of this Public Interest Litigation, petitioner complains of unauthorized encroachment by respondent no.5, over land which is recorded as a chak road.
The petitioner may invoke the provision contained in Sections 25 and 26 of the U.P. Revenue Code, 2006 for redressal of his grievance.
In case, an application invoking the aforesaid provision is filed within a period of 10 days from today, the Sub Divisional Magistrate, Handia, District Allahabad, respondent no.3 shall consider and decide the same by a reasoned and speaking order positively within a period of five months from the date a certified copy of this order is filed before him.
