Heard Sri Indra Bhan Yadav, learned counsel for the applicants, Sri Pankaj Kumar, Advocate, holding brief of Sri Chetan Chatterjee, learned counsel for the complainant and Sri Rajesh Mishra, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicants that the applicants have been falsely implicated in the present case. It has been next submitted that during the course of the trial the victim has turned hostile. The applicants are in jail since 4.3.2016.
Learned counsel for the complainant as well as learned A.G.A. have vehemently opposed the prayer for bail and submitted that as per the statement of the victim under Section 164 Cr.P.C. allegation has been levelled against the applicant.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicants Rajat and Vinod involved in Case Crime No. 94 of 2016 under Section 376D I.P.C. and Section 5/6 POCSO Act, police station Nakud, District Saharanpur.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
