Heard learned counsel for the petitioners and learned Standing Counsel.
This writ petition has been filed against the order dated 17.5.2018 passed by the Deputy Director of Consolidation, Bareilly, whereby the revision filed by the petitioner was dismissed and the order dated 6.6.2016 passed by the Settlement Officer Consolidation in Appeal No. 92 of 2015-16 filed by the petitioner was affirmed.
The contention of learned counsel for the petitioners is that Consolidation Officer reduced the area of plot no. 517 and added the same to plot no. 439.
The finding has been recorded by both the Consolidation Officer as well as Settlement Officer Consolidation to the effect that plot no. 517 was reduced to 2 bigha 5 biswa. Subsequently, the area of the same plot was enhanced to 3 bigha 13 biswa as existed during the settlement (bandobasti) proceeding.
The finding recorded by the consolidation authorities are finding of fact and no prejudice has been caused to the petitioner by the said impugned order, although, the area of plot no. 517 has been enhanced to 3 bigha 13 biswa.
There is no illegality or infirmity in the order impugned herein.
Writ petition is devoid of merit and is, accordingly, dismissed.
