Thottathil B.Radhakrishnan, J. Heard the learned counsel for the review petitioner and the learned Assistant Solicitor General.
Petitioner wanted to tag along the civil service for the purpose of counting the total service to determine the military pension. That was found against by the Armed Forces Tribunal. The Tribunal's decision was affirmed through the judgment sought to be reviewed. Therefore, that does not by itself impair any eligibility of the petitioner for civil pension independent of any claim for military pension, if he is eligible for such relief in accordance with law. We also record the submission that even the Tribunal had left open that issue. This review petition is ordered clarifying accordingly.
