Rajan Sengar & Another vs State Of U.P. Thru. Addl. Chief ...

High Court Of Judicature at Allahabad|18 August, 2021

JUDGMENT / ORDER

Hon'ble Mrs. Saroj Yadav,J.
Heard Mr. Chandan Srivastava, learned counsel for the petitioners and Mr. S.P. Singh, learned A.G.A. for the State and perused the record.
This writ petition has been filed by the petitioners Rajan Sengar and Krishna Bahadur Singh with prayer to quash the impugned First Information Report No.0250 of 2021, under Section 419, 420, 467, 468, 471, 447 and 506 of Indian Penal Code at Police Station Wazirganj, District Lucknow.
Learned counsel for the petitioners argued that dispute is with respect to the plot No.334 which belongs to the respondent No.4, but the petitioners are the marginal witness of the sale deed for which the dispute has arisen between the parties. As per sale deed the plot in question was purchased by Rajendra Singh Bhist being Plot No.10 measuring about 3000 Square feets of Khasra No. 335-Sa, situated at village Dhawan, Tehsil and District Lucknow after making payment of Rs.70 lakh to the seller namely Sandeep Kumar Kanodia, co-accused.
The learned A.G.A. on the other hand opposed the prayer to quash the F.I.R. and submitted that so far as Sandeep Kumar Kanodia co-accused is concerned, various criminal cases has been registered against him, which are as under:
"1. F.I.R. No. 571 of 2020 dated 29.09.2020, under Sections 420, 406, 467, 468, 471, 504, and 506 of I.P.C.,Police Station Gazipur, District Lucknow,
2. F.I.R. No.382 of 2020 dated 10.10.2020, under Sections 504 and 506 of I.P.C.,Police Station Wazirganj, District Lucknow.
3. F.I.R. No.64 of 2021, dated 17.02.2021 under Section 406 of I.P.C.,Police Station Jankipuram, District Lucknow.
4. F.I.R. No.86 of 2021 dated 27.01.2021 under Sections 419, 420, 467, 468, 471 and 506 of I.P.C.,Police Station Chinhat, District Lucknow"
After having examined the submissions advanced by learned counsel for the parties and perused the impugned F.I.R., we are of the opinion that the impugned F.I.R. discloses cognizable offence against the petitioner, hence, no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the F.I.R. or for grant of any interim relief to the petitioners. The present writ petition is dismissed.
The party shall file computer generated copy of order downloaded from the official website of High Court Allahabad, self attested by it alongwith a self attested identity proof of the said person(s) (preferably Aadhar Card) mentioning the mobile number(s) to which the said Aadhar Card is linked, before the concerned Court/Authority/Official.
The concerned Court/Authority/Official shall verify the authenticity of the computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
