Quash the impugned order Dtd.26.7.2014 in M.C.No.983/2013 passed by IV Additional Principal Judge, Family Court at Bangalore vide Annexure-F.
This writ petition coming on for Preliminary Hearing ‘B’ Group, this day, the court made the following:
O R D E R None for the parties. Perused records.
2. In this petition under Article 227 of the Constitution of India, the petitioner has assailed the validity of the order dated 26.07.2014 passed by the Family Court, by which the application preferred by the respondent under Section 24 of the Hindu Marriage Act, 1955 (hereinafter referred to as the ‘Act’ for short) was allowed and sum of Rs.5,000/- was directed to be paid by way of maintenance.
3. A Bench of this Court while entertaining this writ petition by order dated 14.11.2014 had directed the petitioner to pay a sum of Rs.4,000/- by way of maintenance. The order has remained in force for more than 5½ years. Therefore, at this point of time, I am not inclined to adjudicate the validity of the impugned order. By now the proceedings must have been concluded. In case, proceedings are still pending, the Magistrate will make an endeavour to conclude the same within a period of four months from the date of receipt of copy of this order passed today and till the proceedings are concluded by the Magistrate, the ad- interim order granted by this Court on 14.11.2014 shall continue.
Office is directed to transmit copy of this order to the concerned Family Court.
Accordingly, writ petition is disposed of.
