This petition for writ is preferred to challenge the order dated 8 October 2017, whereby, the Assistant Inspector General of Registration, Kanpur Nagar refused to cancel the registered sale deed by keeping the petitioners at liberty to file a civil suit in that regard.
The stand taken by the Assistant Inspector General of Registration is in consonance with the law laid down by this Court in Anil Kumar Vs. State of Uttar Pradesh decided on 11 May 2017 in Writ-C No.- 24128 of 2016 and the Hon'ble Apex Court also in case of Satya Pal Anand Vs. State of M.P. and Others reported in (2015) 15 SCC 263 has taken the same view.
In light of that the order impugned does not suffer any error that may warrant interference from this Court under Article 226 of the Constitution of India.
The writ petition is dismissed.
