Notices on behalf of opposite parties have been accepted by the learned Chief Standing Counsel.
The submission of learned counsel for the petitioner is that the petitioner was working as Carpenter with the opposite parties and has worked upto 31.03.2011, but he was not paid salary after 31.01.2011 on the ground that due to some mistake the date of birth was wrongly read as 17.03.1958 instead of 17.03.1950 and, therefore, the petitioner was retired from service by means of impugned order dated 15.04.2011 with effect from 31.03.2010 and salary for the period from 01.04.2010 to 31.01.2011 was also recovered from the post retiral dues of the petitioner without affording any opportunity.
Further submission of learned counsel for the petitioner is that the petitioner was allowed to continue and work has been taken from him till 31.03.2011, therefore, he is entitled for salary for the period he has performed the duties.
Learned Standing Counsel prays for and is granted two weeks' time to seek instruction/to file counter affidavit.
List this case on 27.02.2012. On that date, the learned Standing Counsel will produce the entire service record of the petitioner.
