Heard learned counsel for petitioners.
Smt. Ramita petitioner no. 2 has been produced today in the Court from Nari Niketan Ballia by Mahila Constable Asha Pal and Constable Vinay Kushwaha.
By the order dated 18.12.2017, Smt. Ramita was directed to be kept in Child Welfare Home by Child Welfare Committee, since then she was kept in Child Welfare Home, Ballia. She states that she has voluntarily married to Raja Ram petitioner no. 1. Due to their wedlock, one female child is also in her lap. Medical report relating to determine her age, has been annexed as Annexure-3 to the writ petition.
According to X-ray report, her epiphysis of long bones around right elbow, right knee and right wrist are found to be fused and according to medical report her age is more than 18 years. She wants to go with Raja Ram as such she cannot be kept in Nari Niketan, Ballia.
In the facts of the case, writ petition is allowed. Smt. Ramita petitioner no. 2 shall be sent at her liberty from Government Child Home (Girl), Nidhariya, District Ballia by Incharge Superintendent on producing the certified copy of this order today. Smt. Ramita shall be return to Government Child Home (Girl) Ballia Nidhariya, District Ballia.
