Sri R.P. Mishra, learned counsel for O.P. No. 3 is not present.
Heard learned counsel for the applicants and learned A.G.A.
This application has been filed with a prayer to quash the chargesheet of case crime No. C-11 of 2001 undr sections 467, 471, 34 IPC, P.S. Rehra Bazar, District Balrampur pending in the court of learned J.M. Utraula, Balrampur.
From the perusal of the record it appears that the FIR and the material collected by the I.O. prima facie disclosing the offence. There is no illegality in submission of the chargesheet and in taking the cognizance. The prayer for quashing the same is refused.
The interim order dated 9.9.2002 is hereby vacated.
In reply of the above contention, it is submitted by learned A.G.A. that this plea may be taken by the applicants by way of moving the discharge application.
Considering the submissions, made by learned counsel for the applicants and learned A.G.A., it is directed that in case applicants move discharge application within 30 days from today before the court concerned through their counsel, the same shall be heard and disposed of under the provisions of law. Till the disposal of that application, the applicants shall not be arrested.
With this direction, this application is finally disposed of.
