Heard learned counsel for the applicant and learned A.G.A for the State.
The instant anticipatory bail application has been filed on behalf of the applicant, Raj Saharma@ Brijesh, with a prayer to release his on bail in Case Crime No.227 of 2020, under Sections-363, 366 I.P.C. and 16/17 POCSO Act, Police Station-Nautanwa, District-Maharajganj, during pendency of trial.
There is allegation of enticement and abduction of minor girl against the applicant.
Learned counsel for the applicant has submitted that the girl is not minor but major.
There is no material to substantiate the argument that the victim is major. Learned counsel for the applicant has passed on High School mark-sheet of the victim which shows that she is aged about 17 years, six months. Therefore, it is not a fit case for grant of anticipatory bail to the applicant.
Application is, accordingly, rejected.
