JUDGMENT / ORDER

Court No. - 58
Case :- HABEAS CORPUS WRIT PETITION No. - 2865 of 2018 Petitioner :- Raj Rani Alias Rani Sharma And Another Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Om Prakash Mishra Counsel for Respondent :- G.A.
Hon'ble Ravindra Nath Kakkar,J.
Supplementary affidavit filed on behalf of respondent no. 4 is taken on record.
This habeas corpus has been preferred with a prayer to direct the respondent nos. 4 to 5 to produce the petitioner no. 1 Smt. Raj Rani @ Rani Sharma (corpus) before this Court or set free at her liberty.
In compliance of this Court's order dated 20.02.2018 the corpus- petitioner no.1 Smt. Raj Rani @ Rani Sharma has been produced before me and on a query being made by me, she in no uncertain terms has stated that she fell in love with petitioner no. 2 and solemnized marriage with petitioner no. 2 on 20.01.2017 at Radha Rani Mandir in Mathura on her own will without any pressure. She further stated that she is major and she wants to live with her husband i.e. petitioner no. 2 Devendra Singh.
In view of the aforesaid observation, I am of the view that if the corpus is major, no one has got right to interfere in her marital life. She is at liberty to go anywhere with her choice. The petition is liable to be allowed.
Accordingly, the petition is allowed and corpus is set free to go anywhere at her choice.
Respondent nos. 4 and 5 are directed not to interfere with the peaceful life of corpus and petitioner no.2.
Order Date :- 27.3.2018 AKT
