Heard Ms. Shambhavi Tiwari holding brief of Shri Anil Kumar Bajpai, learned counsel for the petitioners and learned Standing Counsel. Shri Brijesh Ojha appears for Nagar Nigam.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioners are before this Court for a direction to Judge Small Cause Court, Allahabad to decide Mutation Appeal No.99 of 2016 (Smt. Raj Rani Agrawal & Ors. v. Anand Agrawal & Ors.) within stipulated period.
Shri Brijesh Ojha, who appears for Nagar Nigam has no objection in case the aforesaid proceeding is expedited.
Considering the facts and circumstances of the case and without expressing any opinion on the merits of the issue, the writ petition stands disposed of finally with a direction to the court concerned to consider and decide the aforesaid mutation appeal in accordance with law expeditiously and preferably within a period of one year from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
