Heard learned counsel for the petitioners.
The writ petition has been filed seeking the following relief:-
"(i) Issue a writ, order or direction in the nature of mandamus directing the respondent No. 2 to decide the "Computer Case T20150203042697 of 2015" (Raj Narayan Vs. Manika Prasad & others) u/s 176 of U.P.Z.A. and L.R. Act within stipulated time preferable within three month, pending in the court of learned Sub Divisional Magistrate Tehsil Handia, Allahabad."
It is stated that a partition suit filed by the petitioner in the year 2015 has not been decided finally till date.
Perusal of the order sheet appended to the writ petition reveals that till date, no written statement has been filed. It therefore follows that neither the issues have been framed nor the parties have led their evidence.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 2/Sub Divisional Magistrate, Tehsil Handia, District Allahabad to decide the suit as expeditiously as possible, preferably within a period of 12 months from the date a certified copy of this order is filed before him.
