Petitioner was initially appointed as a Class IV employee in Harjender Nagar Intermediate College, Harjender Nagar, Kanpur Nagar in the year 1973. It appears that a post of Class III employee had fallen vacant and the petitioner staked his claim for promotion. The orders were passed by this Court for consideration of petitioner's claim. The District Inspector of Schools passed an order on 1.1.1982 by observing that as and when a new post of clerk falls vacant, the claim of petitioner for promotion would be considered. It transpires that such order of Inspector was affirmed by a Division Bench of this Court. Thereafter also repeated directions were issued and the petitioner also superannuated in the year 2010 but his claim for promotion has not been examined so far.
Learned counsel for the petitioner has invited attention of the Court to a communication of District Inspector of Schools, Kanpur Nagar, dated 11.6.2018, whereby comments have been called from the Institution concerned in respect of petitioner's grievance relating to non- consideration of his claim for promotion. Submission is that though the matter has remained pending before the Inspector but a final decision is still awaited.
Learned Standing Counsel submits that the claim of the petitioner can be considered by the Inspector at the first instance.
In the facts and circumstances, noticed above, it would be appropriate to dispose of this petition with a direction upon the respondent no. 2 to conclude the exercise initiated by him vide his letter dated 11.6.2018, after affording an opportunity of hearing to respondent nos. 3 & 4, by passing a reasoned order, within a period of four months from the date of presentation of a certified copy of this order. While hearing the respondent nos. 3 & 4, an opportunity of hearing would also be given to the petitioner.
