Heard Sri Pankaj Dwivedi, learned counsel for the applicant, Sri Manu Srivastava, Advocate holding brief of Sri Manish Tiwary, learned counsel for the O.P. No.2 and Sri G.P. Singh, learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been filed with a prayer to quash the impugned charge-sheet dated 15.05.2011 and further criminal proceeding of Criminal Case No. 296 of 2011 under Section 135 of Electricity Act, P.S., Sadar, District Agra arising out of Case Crime No. 286 of 2011.
It is argued by learned counsel for the applicant that proceedings need to be quashed because as per the letter of Authorized Officer annexed at page no. 26, the case of Electricity theft against the applicant has been settled and, therefore, O.P. No.2 does not wish to continue legal action against the accused applicant.
Learned counsel for the O.P. No.2 and learned A.G.A. for the State have to objection in quashing of the impugned charge- sheet as the matter has been settled between the parties.
In view of the above as the offence which is involved in this matter is compoundable one and the matter has been settled out of the Court, hence this Application under Section 482 Cr.P.C. is allowed and the the impugned charge-sheet dated 15.05.2011 and further criminal proceeding of Criminal Case No. 296 of 2011 under Section 135 of Electricity Act, P.S., Sadar, District Agra arising out of Case Crime No. 286 of 2011 stands quashed.
