Heard learned counsel for the applicants.
This petition alleges disobedience of an order dated 1 September 2017 which had required the concerned Naib Tehsildar to proceed in the matter relating to Section 24 of the U.P. Land Revenue Code, 1901 with expedition and decide the same preferably within a period of four months. Before this Court it is not disputed that this order was itself filed in those proceedings only in December 2017. From the order sheet presently therefore the Court is unable to hold the opposite party in wilful or deliberate disobedience.
However, bearing in mind the fact that this matter has been pending on the board of the concerned Naib Tehsildar from 2014, the Court hereby directs the authority to ensure that the said matter is taken up and disposed of with expedition and in any view of the matter within a period of four months from the date of production of a certified copy of this order.
The petition stands disposed of accordingly.
